HC pulls up man for refusing to sign school leaving cert of son living with estranged wife

Bombay High Court reprimanded a father after he opposed to sign his minor son’s school leaving certificate, a document essential for admission in a new school.

According to a report in Times of India, the couple is separated and the custody of the child is with his mother. The child presently resides in Kandivli with his mother. As per the statement from a bench of justice, the father is refusing to sign the school leaving certificate because he wants his son to attend the Santacruz school and travel daily between Kandivli and Santacruz.

Upset with the man's demand of allowing the boy to travel to and fro from Santacruz daily, the court said," Be reasonable. We don't travel such distances. You want a child to travel?"

When it was man's lawyer claimed that it was because the school was a good one, Justice Sawant inquired, "Do you know in which school great (sic) people studied?"

The wife then mentioned that the child's current school in Kandivli was also an ICSE medium and was 25 years old. "The school is close to our place and hence is preferred," she said.

The judges then gave the man an ultimatum, "You want us to make him sign? We'll call him here. Advice your client to sign the school leaving certificate form," said Justice Sawant.

The judges warned the couple that they should not let their differences affect the child.
